Terms and Conditions for Patients – Między Falami Psychoterapia

§ 1. General provisions
  1. These Terms and Conditions (hereinafter: “Terms and Conditions”) set out the rules governing the relationship between Między Falami Psychoterapia (hereinafter: “the Practice”) and the Patient in relation to services provided electronically (online).

  2. Booking an appointment or completing the “Registration Form” constitutes acceptance of all provisions of these Terms and Conditions.

  3. Między Falami Psychoterapia does not maintain medical records within the meaning of the Act of 6 November 2008 on patients’ rights and the Patient Rights Ombudsman.

  4. The therapeutic process requires the Patient’s active involvement. It should be borne in mind that whilst working through one’s difficulties, there may be a temporary, transient deterioration in well-being, which is a natural part of the process of change.

  5. The effectiveness of the process depends on the Patient’s active attitude and their own work on the agreed issues between appointments.

§ 2. Booking and payments
  1. Patients can pay for their appointment in two ways:
    • Via the ZnanyLekarz payment system (link sent automatically).
    • By bank transfer to the company’s bank account.
  2. If paying by bank transfer, please state the following in the payment reference: “Patient’s first name and surname, date of appointment”.
  3. Payment deadline: The appointment must be paid for no later than:
    • 24 hours before the scheduled appointment time for appointments taking place from Tuesday to Friday.
    • for appointments taking place on Mondays – by the end of the preceding Friday at the latest.
  4. The appointment is considered paid for upon:
    • completion of payment via the Znany Lekarz service (link sent automatically), or
    • submission of a bank transfer confirmation to the email address: kontakt@miedzyfalami.com.
  5. Failure to make payment via the automatic link by the deadline or failure to provide a bank transfer confirmation by the deadline will result in the cancellation of the booking.
§ 3. Cancellations and rescheduling
  1. The Patient is entitled to cancel or reschedule an appointment free of charge, provided that the following deadlines are met:

    • at least 24 hours before the scheduled appointment for appointments taking place from Tuesday to Friday.

    • for appointments taking place on Mondays – by the end of the preceding Friday at the latest.

  2. If the above deadlines are not met or the Patient is absent, the fee paid is non-refundable and the Patient remains liable for the full cost of the appointment.

  3. If the appointment is cancelled by the Specialist or the Practice for reasons attributable to them less than 24 hours before the scheduled time, and the appointment has been paid for, the Patient will be refunded the full cost.

    • In addition, the Patient is entitled to one additional, free appointment, provided that the reason for the cancellation is not a force majeure event (e.g. sudden illness, force majeure). If you wish to make use of this free appointment, please notify us by email at: kontakt@miedzyfalami.com within 14 calendar days of the date on which the appointment was due to take place.

§ 4. Confidentiality Policy
  1. The entire course of the consultation and the very fact of seeking assistance at Między Falami Psychoterapia are subject to strict professional confidentiality.

  2. The professional is released from the duty of confidentiality only in the following situations:

    • where there is reasonable suspicion that the life or health of the patient or other persons is at risk, or

    • where the professional is released from professional secrecy by a court or a prosecutor, in accordance with Article 180 of the Code of Criminal Procedure.

§ 5. Conditions for online consultations
  1. The Patient is responsible for ensuring they have a stable internet connection and a private, quiet space.

  2. Safety: The consultation cannot take place if the Patient is in circumstances that pose a safety risk or prevent them from concentrating (e.g. whilst driving).

  3. The consultation will be immediately terminated and deemed to have been cancelled due to the Patient’s fault, without the free cancellation period referred to in § 3 of these Terms and Conditions applying (with full payment due), if the Professional determines that the Patient:

    • is driving a motor vehicle during the call, or

    • is under the influence of psychoactive substances, or

    • is behaving aggressively.

§ 6. Refusal and termination of treatment
  1. The Practice and the Professional reserve the right to refuse to provide services or to terminate ongoing treatment if:

    • there is a conflict of interests, or

    • the Professional determines that the Patient requires a different type of care (e.g. hospitalisation or admission to an addiction treatment centre), or

    • the Professional fears for their safety.

§ 7. Protection of personal data (GDPR)
  1. The rules governing the processing of personal data are set out in detail in the Privacy Policy in accordance with the GDPR.

  2. Should the data processing rules be updated, the Patient will be notified of the changes by email. Notifying the Patient in this manner is deemed to be effective and sufficient.

  3. A Patient who does not agree to the new data processing terms has the right to object by sending the relevant information to: kontakt@miedzyfalami.com, which is synonymous with resignation from further use of the services offered by the Practice.

§ 8. Complaints
  1. Any complaints regarding services provided should be submitted by email to: kontakt@miedzyfalami.com.

  2. Complaints must be submitted within 14 calendar days of the date of the appointment (or the date on which it was due to take place).

  3. The Practice will respond to the complaint within 14 working days.

§ 9. Final provisions
  1. Między Falami Psychotherapy reserves the right to amend these Terms and Conditions.

  2. The Patient will be notified of any changes to the Terms and Conditions by email. Notification of the Patient in this manner shall be deemed effective and sufficient.

  3. A Patient who does not agree to the new provisions of the Terms and Conditions has the right to object by sending a relevant notification to: kontakt@miedzyfalami.com, which is synonymous with resignation from further use of the services offered by the Practice.

  4. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply.
